Auto parts store employee facing charges for shooting customer after fight in store

An auto parts store employee seen on a social media video firing a weapon after being assaulted by a customer is facing charges.

Police responded to the O’Reilly Auto Parts store in W. Third Street in Dayton Thursday evening on reports of a shooting.

Video posted to social media showed two women in a physical altercation. When the pair briefly broke away from each other, an employee, later identified as 31-year-old Ke’Laron Watson, went to the counter, grabbed a gun and fired one shot at the other woman.

That woman was taken to Miami Valley Hospital by her boyfriend, according to the affidavit and statement of facts. News Center 7 checked Monday afternoon and that woman had been discharged from the hospital, according to a Miami Valley Hospital spokesperson.

When police arrived on scene, they said Watson admitted to shooting the other woman and told officers the gun was in her car. Police then took Watson into custody.

Watson told officers that she was helping the woman find a car part when she became upset and threatened her. She also told officers that the woman attacked her and “beat her about the head with her fists,” according to court documents.

Watson said she fired her gun because she though the woman was coming at her for another attack.

“She put her hands on me and she pulled my hair out and everything else. And while she was beating on me, I shot her,” Watson said in a 911 called obtained through a public records request.

Video of the incident showed the attack and Watson retrieving a gun, pointing it at the woman and firing it at her as she walked away, according to court records.

Customers at the store told News Center 7 that they were trying to wrap their heads around what happened.

“I don’t know, I’m glad I am not in that situation where I have to chose to defend myself and shoot somebody,” Enoch Bush, Jr., of Dayton, said. “I don’t want to be in that position.”

Ravonda Holliday-Greene, of Dayton, saw the video of the incident and was saddened by what she saw.

“Yes, its heartbreaking,” Holliday-Greene said.

Watson is now facing two counts of aggravated assault and one count of felonious assault. News Center 7 was in court today for her first court appearance Monday where a judge set her bond at $50,000.

Watson is scheduled to appear in court next on July 15.

这个案子比之前德州老中在汽车修理店开枪被诉那个。。。更没啥好说的，基于文中描述，被诉不为过。

我是看了视频跟文中内容才得到我的结论，你有看视频吗？

当然我的结论跟警察不一样，我是站在受害人的立场。

商店店员在攻击者转身的一霎那开枪了。那是因为我们能看视频慢动作。在当时的场景，我觉得他是自保了。

警察还是把店员抓了，所以我才说警察对合法有抢不友好，你中文合格吗？

我相信陪审员看了视频也会站店员受害者的一方。

我完整的看了视频。

首先，我们先同步下美国的枪法，只有在收到人身致命威胁时候，动枪制止威胁才是合法的。这里有几个细节：

1、所有州都同意在自身致命威胁下，动枪合法。大部分州不允许为保护财产动枪。为保护他人安全动枪是否合法，也就是citizen arrest，不同州细节规定有很多不同。

2、退让原则，也就是在遇到威胁时候，是否需要先退让，再反击，这一点部分州需要退让，部分州不需要。

3、追击原则，也就是当袭击方退让，或者中止之后，被袭击方是否有追击的权力。这一点很多州是不同的。

在这个视频中，冲突双方处于搏斗阶段，被袭击者用枪还击是没有问题的，毕竟不断击打头部已经构成致命威胁。

但是在被袭击者已经摆脱袭击，双方之间相隔1-2米，袭击者已经收拾衣服转身离开的瞬间。这时候开枪，是否合法，需要根据当地州法律来判断，我个人认为。。。有问题。

如果警方或者检察官认为，开枪时候，双方第一轮冲突已经结束，那这个案子对开枪者更加麻烦，被诉个二级谋杀不为过。

文章中的文字描述，警方和检察官的观点，跟我上面的个人判断类似，这也是开枪者被诉的原因。

我认为你在夸大其词，或者不太懂美国相关法律，基于以上理由。

这中间的法律判定跟是否用枪没关，用斧子砍过去，法律上的处理一样。拥枪的人，没必要自己给自己加受虐的戏。
