我觉得有的人（不是本帖当事人，也不是什么靴子当事人）可能有想出热闹的心理。反正买家又不麻烦，嚷嚷一阵，就一个高楼开始了。我们旁观者有时候不也有阴暗的喜欢看出事了集体微观的嘛。自从那个什么包，搞的跟福尔摩斯一样，仿佛这种什么“猜测”“怀疑”就成了流行了。

其实这事本来卖家是理亏的，本来好好能解决的，但是买家非要把这个舆论导成这样子，让人家卖家吃了亏（自己买到没保质期的东西也是吃亏吧，还浪费这么多去邮局什么的effort）还要被人家扇不明不白的一巴掌。。。。。

GOVERNMENT GUIDELINES.  What does the government say? The Food & Drug Administration, which regulates packaged foods and drugs, only requires a use-by, or expiration, date on infant formula. That's because formula must contain a certain quantity of each nutrient that is described on the label. And if formula is stored too long, it loses its nutritional quality, and also separates or form lumps that will clog the bottle nipple.

The Agriculture Dept., which regulates fresh produce and meats, only requires labeling of the date when poultry is packed at the farm. However, many manufacturers are allowed to also add sell-by or use-by dates. "Grocery stores that grind their own meat can add their own package labels," says USDA spokesman Steve Cohen.

In fact, both the FDA and the USDA have a pretty laissez-faire attitude when it comes to food shelf-life labeling. That's not because they are not concerned for people's health. Mark Harrison, professor of food science at the University of Georgia, points out that most of these dates are not an indicator of safety, rather of quality. "Some foods spoil if not refrigerated quickly enough—but they won't kill you," says Harrison.

With exception of certain poultry, baby food products and formulas most all other food product expiration dates are not required by federal law but are voluntarily provided by food manufacturers.  This does vary from state to state and many states legislate sell-by dates for perishable foods.  According to several sources including the USDA there are 20 states that require some mandatory labeling for dairy products.  So far we know that Arizona, California, Ohio, and New York have some labeling laws.  (Read about California's milk labeling law)

Dates Are Guidelines
On the most part dates are provided as guidelines for both product sellers and the buying public.  Most dates are NOT expiration dates; you are not going to get sick because you eat something past its "best by" date.  Some dates have become marketing devices for product manufactures.  A good example of this are dates that are appearing on soft drinks.  There really is not much to expire with a beverage made of water, sugar, and artificial coloring.  This is one of those cases where the manufacturer appears to just be encouraging you to throw it out and buy more.

因此转让没有生产日期，只能是不被卖家prefer，但不违反法律。所以卖家在法律上似乎都没有什么过失。查生产日期，作为一个guideline，是人们习惯参考的一个标准而已，除了几类食品意外，FDA 并没有强硬要求。

唯一卖家可能出错的地方是：她说有生产日期，而买家收到上面没有，此为”售出物品与描述不符“，而看样子买家mm当时急于购买，也没有询问此方面问题，卖家也没有主动对生产日期进行任何描述

怎么恶意揣测她都不为过？

如果一个罪犯犯了一个应该判三年的罪，法庭”怎么恶意揣测他都不为过“，随手给判个三十年，对吗？

 再说，我先前还没看法律部分，现在看了法律部分，卖家凭啥要退要换呢？除非卖家之前拍着胸脯说这上面有生产日期，属于”不符描述“。或者，发的不是小肥羊，而是小瘦羊。
